Delivery of a Controlled Substance – Penalty groups and Penalties in Texas

Among the many enemies of today’s society, illegal drugs have been probably the worst. Apart from the fact that it drastically changes a good-natures person into someone or something monstrous beyond compare, it also affects, worse yet, the people around and within the drug user’s life. True enough, the aftermath of the use of illegal drugs has become a terrible consequences that not only the user faces but more so his family – the embarrassment around the community, the many hours spent on counseling and rehabilitation, the family adjustments needed to be made, the tightening of the budget, only to mention a few.

It is in this regard that authorities all over the world have been stretching all their means and power to conquer the spread and circulation of drugs. On a specific note, Texas authorities have grouped the penalties of the delivery of a controlled substance (illegal drugs) into four, depending on the type of the drug being delivered and the amount of the drug that is being confiscated.

Penalty Groups and Penalties

As stated above, there are four penalty groups for delivery of a controlled substance case and they are the following:

1.The first group includes several pain-medications or components that are used to make these pain medications. Examples of these are codeine, morphine, heroin and others. The penalties for this type of drugs will range from state jail felony for delivering 1 gram up to life imprisonment and fine of $250,000 for substance greater than 400 grams.

2.The next group includes hallucinogenics like mescaline and amphetamines. These are the drugs that will bring people to a state of hallucination which will eventually change the thought perspective of the user. Penalties involving this substance will start from state jail felony for those who have delivered or manufactured up to 1 gram of the drugs.  Life imprisonment together with a fine reaching up to $100,000  await those who have been involved with greater than 400 grams of drugs.

3.The third group of illegal substance would include drugs that serve as stimulants or depressants which have direct effect on the central nervous system like Phenobarbital – its effect on the central nervous system may include ataxia or absence of proper muscle coordination, dizziness, and nystagmus or involuntary movement of the eye. The penalty for this group includes state jail felony for 28 grams of drugs or less.  It will also have life imprisonment for those who have been involved in greater than 400 grams of drugs and a fine reaching up to $100,000.

4.The fourth and last group includes the anabolic steroids that can also give a lot of adverse effects to users. The penalty for this group is also the same with group 3.
