False Convictions Happen Usually With Sexual Offenses Cases In Various States Including Texas
It is not uncommon for us to hear of many cases of people being sent to prison just because they were wrongfully accused of a crime they did not commit. This can really be unfair for those convicted but are really not guilty that they suffer from the lack of judicial support and thorough examination. Some lose over reasons of graft and corruption in the court room.
Since the very first prisoner in the US was freed from guilt in 1989, the process of putting someone to jail or a death sentence was improved. This was especially true when the tool of DNA evidence emerged in the scene. Such technological improvements and funding for the court processes gave way for the setting free of almost 200 prisoners who were all falsely accused but have already suffered some terrible years in prison.
Sexual Offenses as the Usual Crime
Most of the reasons behind the false convictions and inappropriate arrest of many people in the Unites States were those that involve sexual offenses. This is because by simple nature, such crime only happens between the victim and the assailant. It is a good thing if witnesses can attest to the truthfulness or the untruthfulness of the crime, because most of the time, the victim gets brainwashed by too many people involved who also hold their own malicious intent, hence, with the rising of the DNA evidence technology. With the DNA technology, these so-called emotional cases came to improve even without the presence of reliable witnesses. This technology was not made available until the late eighties.
Texas and beyond
In California, there were 9 verdicts involving sexual offenses which were overturned. It was just in Louisiana, Virginia, and Texas where more of the convictions were proven false. Research and survey experts, however, greatly disagree with the statistics which say that the wrongful convictions would be just about .5 to 10 % of all the rest of the convictions. In reality, these research experts believe that when you actually relate it to the real number of people with so many lives and families destructed by such a surprise of wrongful conviction, then there would be about 10,000 to 100,000 falsely convicted individuals behind bars.
Improved Statistics
Recently, there have been some good signs of improvement in the statistics of false convictions and accusations. This is of course in the case of sexual offenses. Even if it took about thirteen long years of various defense attorneys to achieve the 11 post-conviction freeing, the prisoner counting to be the 200th was able to gain back his freedom only after five years have already passed.
Many defense attorneys are never losing hope in seeing a brighter future for the judiciary courts of today. It can be advantageous if the system would not hesitate to try these new technological and more modern systems to help in the proper processing of cases of both victims and suspects. If we want to gain full justice and freedom in a democratic country we live in, we must continue to fight for our rights no matter what happens in the long run.
