The issue of child pornography has constantly plagued nations all over the world. In fact, ninety-four (94) countries across the globe have their specific laws that address the concern of such issue as it has become a sensational and astounding subject for many people. Such sensation has reached a point of having people involve themselves into numerous movements that call to criminalize child pornography in the global sense. This action, people believe, will conquer the spread and rampancy of the case so as the rights of children to freedom and morality are observed and protected.
Child pornography is, by general definition, a variety of writings, images, and films that depict lewd and sexual activities concerning a child below the pubescent period. The issue id considered a crime itself as it is being related to child abuse. In the legal essence, on the other hand, child pornography involves images that include not only the pubescent period but also the pre-pubescent and the post-pubescent stages of a child’s life.
Considered as the fastest escalating topic in the World Wide Web, child pornography is considered an industry of multi-billion dollar cases that involve lascivious acts, distribution of pornographic materials in and out of the United States, private sexual cases, trafficking, and pedophilia. In Texas alone, child pornography has struck in devastating number of cases which paved way for the resolution of special child pornography rules in the said state.
Under the Texas Penal Code Section 43.26, the following cases define and cover child pornography:
1.If a person intentionally and knowingly possesses materials for visual use that depicts a person who is younger than the age of eighteen (18).
2.Any media material such as video tape, photo negative, movie or film, photograph that exploits a child – pre-pubescent, pubescent, or post-pubescent- in sexual manner.
3.Physical media such as CDs, DVDs, or diskettes that allows a child’s sexual image on the computer or video screens that can be transmitted by cable, telephone, and other similar methods.
4.If a person has the very intention to spread the use of the sexually explicit material.
5.If a person has more than 6 copies of lewd and pornographic materials which cover sexual exploits of children.
Consequences for this acts of crime involves imprisonment of six months to ten years plus a fine of not more than $20,000. It is true that the future of a child depends on his present. To abuse his present would mean a totally damaged future that may not be healed and recovered. Respect comes not only for the elderly, it goes out for everyone else – children included.
